Terms and Conditions of Sale
These Terms and Conditions (the "Terms") govern the sale of goods and services by Wallow Wine Limited (trading as "Wineslut").
WINESLUT is a registered trade mark, and all associated intellectual property rights, trade marks, and brand assets are the sole and exclusive property of Wallow Wine Limited (Company Number: [Insert Company Number], Registered Office: [Insert Registered Address]).
Please read these Terms carefully before placing an order. By placing an order with us, you agree to be bound by these Terms.
1. Age Restrictions

1.1 By placing an order with Wineslut, you confirm and warrant that you are 18 years of age or older.
1.2 Under the Licensing Act 2003, it is an offence for any person under the age of 18 to buy or attempt to buy alcohol, or for any person to buy alcohol on behalf of a person under the age of 18.
1.3 We operate a Challenge 25 policy. If our delivery couriers are in any doubt regarding the age of the recipient, they will request valid, government-issued photographic identification (such as a passport or driving licence). If suitable identification cannot be provided, the delivery will be withheld, and a redelivery fee may apply.

2. Payment and Cardholder Verification

2.1 When providing credit or debit card details to Wineslut, you confirm that you are the authorised cardholder or that you have explicit, lawful permission from the cardholder to use the card for the transaction.
2.2 For promotional cases, complimentary gifts, or cases provided via our partners, you must still provide valid credit or debit card details for verification, age screening, and to cover any applicable delivery charges, even if the value of the wine itself is £0.00.

3. Processing Payments and Continuous Payment Authority

3.1 Payment will be debited from your card immediately upon placing an order, or on the recurring billing date for subscription or monthly payment plans.
3.2 To facilitate convenient future transactions and subscriptions, we securely store your payment details using a PCI-DSS compliant third-party payment gateway.
3.3 We will only process payments that you have authorised (such as via automated subscription renewals, continuous payment authorities, or one-off purchases). You may cancel a continuous payment authority at any time by contacting us.

4. Order Acceptance and Cancellation by Us

4.1 The display of products on our website constitutes an "invitation to treat" rather than a legally binding offer. A contract is only formed between you and Wallow Wine Limited when we dispatch the goods and send you a dispatch confirmation email.
4.2 We reserve the right to decline or cancel any order (or part thereof) at our sole discretion before dispatch (e.g., due to stock unavailability, pricing errors, or failed security checks).
4.3 If we cancel your order, we will notify you as soon as possible and issue a full refund to the original payment method within 14 days.

5. Delivery Services and Charges

5.1 Our standard delivery service typically takes 1–2 working days (Monday to Saturday) to most UK addresses for orders placed before 5:00 pm. During peak periods, we reserve the right to move the 5:00 pm cutoff time forward to ensure we can fulfil existing orders.
5.2 Standard delivery is charged at £9.99, or is free of charge for orders exceeding £200.00 in value, subject to the following exceptions:
• Promotional, clearance, or "sale" cases may be excluded from free delivery, as highlighted on the product page.
• When using a voucher, gift card, or claiming a free promotional bottle, a minimum personal expenditure of £100.00 (excluding the voucher/gift value) is required to qualify for free delivery.
5.3 Next-day or named-day delivery is available to eligible postcodes for a fee of £12.99.

6. Delivery Restrictions

6.1 We cannot guarantee delivery to certain remote or offshore areas of the UK (including parts of the Scottish Highlands, Islands, Northern Ireland, the Isle of Man, and the Channel Islands).
6.2 Please consult our website for the comprehensive list of excluded or restricted postcodes before placing your order. Additional delivery surcharges and extended delivery windows may apply to these areas.

7. Risk, Title, and Missing Orders

7.1 Risk of damage to, or loss of, the goods passes to you at the time of delivery. Delivery is deemed complete when the goods are left at your specified delivery address (including safe place instructions) or with an authorised recipient.
7.2 If an order is lost in transit or deemed undeliverable, we will arrange a replacement dispatch. If we are unable to dispatch a replacement within 7 days, we will offer you a full refund.
7.3 Ownership (title) of the products will only pass to you once we have received payment in full.

8. Fraud Prevention and Security Checks

8.1 To protect our customers and prevent online fraud, we reserve the right to conduct identity, age, and fraud prevention checks.
8.2 We may share your details with, or contact, your card issuer or credit reference agencies to perform these checks. Your personal data will be handled strictly in accordance with our Privacy Policy and UK GDPR.

9. Vouchers, Discounts, and Promotions

9.1 All promotional codes, vouchers, and discounts are limited to one use per customer/household and cannot be used in conjunction with any other offers, promotions, or discounts unless explicitly stated otherwise.
9.2 We reserve the right to withdraw, amend, or terminate promotions at any time without prior notice.

10. Payment Restrictions on Specific Products

10.1 Certain products (including but not limited to pre-order deposits, tasting event tickets, and masterclasses) must be purchased using direct payment methods (debit/credit card or cash funds deposited into your account).
10.2 Account credits, promotional vouchers, or goodwill credits cannot be used to purchase these specific products.

11. Product Availability

11.1 All products shown on our website are subject to availability.
11.2 We reserve the right to withdraw any product from sale, modify prices, or update descriptions at any time without notice and without liability.

12. Substitution Policy

12.1 Wine is an agricultural product and stock levels of specific vintages or labels can fluctuate. If we are unable to supply the exact wine you ordered, we reserve the right to substitute it with a similar wine of equal or greater value.
12.2 If you are not satisfied with the substitution, it is covered by our return and refund policy (see Clause 13).

13. Returns, Cancellations, and Faulty Goods
Note: This section has been aligned with the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

13.1 Your Right to Cancel (Change of Mind): As a UK consumer, you have the statutory right to cancel your contract with us and return your order for any reason within 14 days of receiving the goods.
• To exercise this right, you must notify us of your decision to cancel within the 14-day window.
• You must return the products to us in their original condition, unopened, with seals and labels intact, within 14 days of your cancellation notice.
• You are responsible for the direct cost of returning the goods, unless we agree to collect them. We will refund the price paid for the goods, plus our standard delivery charge, within 14 days of receiving the returned goods (or proof of return).
13.2 Faulty or Damaged Goods: Under the Consumer Rights Act 2015, we have a legal duty to supply goods that are of satisfactory quality, fit for purpose, and as described.
• If a wine is corked, faulty, or damaged upon arrival, please contact our Customer Happiness Team.
• You have a statutory right to a full refund or replacement if the goods are faulty, provided you notify us within 30 days of delivery.
• We may require the return of the faulty bottle(s) (at our expense) or photographic evidence of the damage to process your refund or credit.
13.3 Limitations: We reserve the right to refuse refunds, returns, or credits if we have reasonable grounds to believe a request is fraudulent, dishonest, or an exploitation of our goodwill policies (such as returning empty bottles or claiming refunds on gifts that have been consumed).

14. Gift Orders and Personal Messaging

14.1 For gift deliveries, your name and postcode will be printed under your personal message to allow the recipient to identify the sender.
14.2 To protect your privacy during transit, these details are concealed beneath a lift-up message flap and will only be visible when the recipient opens the gift message.

15. Governing Law and Jurisdiction

15.1 These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes), shall be governed by and construed in accordance with the laws of England and Wales.
15.2 You and Wallow Wine Limited agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
